Achja, da sich der Rauch um die angeblichen 235 Software-Patente gegen die Open-Source verstossen würde gelegt hat, Zeit das der Autor der Studie auf die sich Microsot bezieht sich meldet um die Sache ins rechte Licht zu setzen. Dan Ravicher, Anwalt der PUBPAT (Public Patent Foundation), sagt in der eweek intressante Dinge, wie z.B:
“Microsoft is up to its usual FUD [..] Open source faces no more, if not less, legal risk than proprietary software. The market needs to understand that the study Microsoft is citing actually proves the opposite of what they claim it does.”

Patents don’t care how the infringing article is distributed, be it under an open-source license, a proprietary license or not at all. Therefore, if a patent infringes on Linux, it probably also infringes on Unix, Windows, etc.,
Am intressantesten finde ich diesen Satz, denn er zeigt eindeutig das Software-Patente nicht nur eine Bedrohung für Open-Source ist, sondern für die gesamte Software-Branche:
The bottom line is there’s no reason to believe that Windows, Solaris, AIX or any other functionally similar operating system has any less risk of infringing patents than Linux does
